Terms and Conditions and Information on the Processing of Personal Data – Cookies


TRANSPETROL, a.s., Šumavská 38, Bratislava 821 08, IČO: 31341977, a joint-stock company registered in the Commercial Register of the District Court Bratislava I, Section: Sa, File No.: 507/B (hereinafter referred to as “TRANSPETROL”) as the controller collects and processes the personal data of data subjects, to whom it hereby provides information within the meaning of Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27,April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, repealing Directive 95/46/EC (“GDPR”) and taking into account Act No. 18/2018 Coll. on the Protection of Personal Data and on Amendments to Certain Acts (“ZOOÚ”).

 

Cookies are small text files that your internet browser stores or loads onto the hard drive of your device (e.g., computer, laptop, or smartphone) through the websites you visit for the purpose of storing certain information or image files, such as pixels. The next time you visit our website on the same device, information about your cookies will already be stored. Cookies are transmitted either to our website (“first-party cookies”) or to another website to which the cookies belong (“external cookies” or“third-party cookies ”). If you visit our website from a device other than the one on which you have already set cookies, or if there is a change in the cookie processing procedure (e.g., modification of the expiration date, etc.), you will be asked again to set your cookies on our website—that is, for example, to provide your consent and/or set your preferences. TRANSPETROL, a.s. currently uses only its own cookies.

 

We use cookies for various purposes, but primarily to display our website to you in the best possible way and to ensure that it functions properly in accordance with your preferences.


From the perspective of protecting personal data, it is important to assess what data is contained in a particular cookie. If the data stored in the cookie includes any identifier that, on its own or in combination with other data, is capable of directly or indirectly identifying a natural person—the user of the web browser—such cookies must be considered personal data within the meaning of Article 4(1) of the GDPR.

Depending on the type of relationship with the controller, the table below lists the purposes of processing personal data (hereinafter referred to as“PD”), specifying the category of data subjects, the legal basis for processing, the categories of PD processed, and the period for which the controller will process such PD.

To which countries do we transfer your personal data? 

Transfers to third countries shall not be carried out, nor shall automated individual decision-making, including profiling, take place.


If the legal basis for the processing of personal data is a law, the provision of such data is a legal requirement. Without such data, it is not possible to ensure that Transpetrol, a.s. properly fulfills its obligations under the relevant general legislation. In that case, without personal data, the operator’s website would not function.


In particular, the data subject shall have the following rights with respect to the processing of personal data: 

  1. upon request, to request confirmation from TRANSPETROL, a.s. as to whether or not their personal data are being processed (access to personal data), under what conditions—including the scope, purpose, and duration of such processing—and information regarding the source from which the personal data in question were collected; 

  2. upon request, to request that TRANSPETROL, a.s. correct inaccurate or outdated personal data, or complete incomplete personal data; 

  3. upon request, to require TRANSPETROL, a.s. to delete or destroy personal data if: 

  1. the personal data are no longer necessary for the purpose for which they were collected or otherwise processed, 

  2. in cases where personal data have been processed on the basis of consent and that consent to the processing of personal data has been withdrawn, provided that there is no other legal basis for the processing of personal data or another legal exception;

  3. if the data subject objects to the processing of personal data on the basis of a legitimate interest and there are no overriding legitimate grounds for the processing, or if the data subject objects to direct marketing;

  4. personal data are processed unlawfully; 

  5. In order to comply with a legal obligation, personal data must be deleted;

  1.  upon request, to require TRANSPETROL, a.s. to restrict the processing of personal data if: 

  1. the data subject objects to the accuracy of the personal data for a period that allows TRANSPETROL, a.s. to verify the accuracy of the personal data; 

  2. the processing of personal data is unlawful, and the data subject objects to the erasure of the personal data and requests that its use be restricted instead; 

  3. TRANSPETROL, a.s. no longer needs the personal data for the purpose of processing personal data, but the data subject needs them to assert a legal claim; 

  1. file a motion to initiate proceedings with the Office for Personal Data Protection of the Slovak Republic. 


The data subject is entitled to submit requests regarding the above rights to the data protection officer at zo_oou@transpetrol.sk, or in person or by mail to the controller’s address. In the subject line of both the email and the letter, please include “Privacy Policy: Cookies.”


Responses to such requests from the data subject or actions taken in response to such requests shall be provided free of charge. If the data subject’s request is manifestly unfounded or disproportionate, in particular due to its repetitive nature (confirmatory request), TRANSPETROL, a.s. has the right to charge a fee reflecting its administrative costs for providing the information or a reasonable fee reflecting its administrative costs for notification, respectively, or to take the requested action, or has the right to refuse to act on such a request.
